Rhode Island Brain Injury Lawyer

While others say justice for all, we say justice for you.

A brain injury does not always show on a scan, and it rarely shows on the day. Headaches, memory gaps, mood changes, and fatigue that surface weeks after a crash or fall are the injury. We build claims that take the full picture seriously, because insurers will not.

Do you have a brain injury claim in Rhode Island?

Most claims come down to three questions. If the answer to all three is yes, it is worth a conversation, and the conversation costs nothing.

Was there a blow or jolt to the head?

A crash, a fall, a sports collision, an assault, or a workplace incident. Loss of consciousness is not required; many serious injuries involve none.

Have symptoms persisted or appeared later?

Concentration, memory, sleep, balance, irritability, sensitivity to light and noise. Post-concussion symptoms lasting weeks or months are a recognized injury.

Was someone else responsible?

The driver, the property owner, the employer's contractor, the product maker. If their carelessness caused the impact, the brain injury is their responsibility.

Brain Injuries

How we build a Rhode Island brain injury case

The right specialists

Neurologists, neuropsychologists, and where needed neuroradiologists who can identify and explain injury that general imaging misses.

Before and after

School and work records, performance reviews, and accounts from family and colleagues establish who you were before the injury and what changed.

The cause

The crash, fall, or incident is proven the same way any injury claim is, with the added focus on the mechanism of the head impact.

The future

Life care planners and vocational experts project the cost of care and the effect on earning capacity over a lifetime.

Compensation

What a claim can cover

Not every category applies to every case. Which ones apply to yours depends on the injury, the evidence, and the insurance available.

Money you have lost

  • Emergency care, hospital stays, and surgery

  • Ongoing treatment, therapy, and medication

  • Projected future medical care

  • Wages lost while unable to work

  • Reduced earning capacity going forward

  • Property damage

Harm that has no invoice

  • Physical pain, during recovery and after

  • Emotional distress and loss of sleep

  • Scarring and disfigurement

  • Loss of the activities that made life yours

  • Loss of companionship within a marriage

How it is paid

  • Through the responsible party's insurance

  • Through your own uninsured or underinsured coverage where it applies

  • By settlement, or by verdict if a fair settlement is refused

  • With every deduction itemized in writing before you sign

Right now

What to do next

What you do in the first days affects what the claim is worth months later. None of this requires hiring anyone.

1

Get evaluated now, even if the ER cleared you

Ask for a referral to a neurologist or concussion clinic. Early documentation of symptoms is critical.

2

Keep a daily symptom journal

Headaches, sleep, memory lapses, mood. Dated entries become evidence.

3

Ask the people around you to note changes

Family and coworkers often see what you cannot.

4

Do not minimize at medical visits

Describe every symptom. Records that say 'feeling fine' are used against you later.

5

Avoid giving statements to insurers

Memory and concentration problems make recorded statements especially risky.

Common questions

Brain Injuries questions we hear first

My CT scan was normal. Can I still have a brain injury?

Yes. Standard CT and MRI scans frequently miss mild traumatic brain injury. Persistent symptoms after a head impact are the injury, and neuropsychological testing and advanced imaging can document what standard scans cannot.

What is a brain injury claim worth?

It depends on severity, permanence, and the effect on your ability to work and live independently. Because these effects can last a lifetime, brain injury claims are valued differently from injuries that heal. No figure can be given before the medical picture is clear.

How long after a crash can symptoms appear?

Days to weeks. Delayed onset is common and medically recognized. The important thing is to document symptoms with a doctor as soon as they appear.

Does the three-year deadline start when symptoms appear?

Generally it runs from the date of the injury, not the date symptoms were recognized. This is one reason early evaluation after any head impact matters.

Do I pay anything up front?

No. Brain injury cases are handled on a contingency fee. The consultation is free, there is no hourly billing, and the fee is a percentage of any recovery set out in a written agreement. If there is no recovery, no attorney's fee is owed.
